1. Introduction

Welcome to Nipun India Skill Development And Training Private Limited ("we," "our," or "us"). These Terms and Conditions govern your use of our website, services, and any related applications (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Services

Nipun India Skill Development And Training Private Limited provides skill development and training services including but not limited to:

• Vocational training programs
• IT and programming courses
• Digital marketing training
• Beauty and wellness courses
• Technical skills development
• Healthcare training programs
• Certificate programs
• Franchise opportunities
• WhatsApp alerts for schools and institutes (see section 2A)

2A. WhatsApp Alerts for Schools

These terms apply to schools, institutes and software companies ("Customer") that use our WhatsApp alerts service, including the dashboard and the API.

Acceptable use

• The Customer must send messages only to people who have agreed to receive WhatsApp messages from the Customer, and must stop messaging anyone who asks to stop
• No spam, no messages to purchased or scraped number lists, and no content that is illegal, misleading or abusive
• The Customer must follow the WhatsApp Business Messaging Policy, the WhatsApp Business Terms and Meta's commerce policies
• The Customer is responsible for the accuracy of student and parent data and for the content of its messages

WhatsApp Business account

The Customer connects its own WhatsApp Business account and phone number, which remain the Customer's. Meta approves message templates and sets messaging limits and quality ratings. We are not responsible for decisions Meta makes about a Customer's account, templates or number.

Fees and message credits

• The service has a platform fee, plus charges for each WhatsApp template message as set by Meta
• Prepaid message credits are used as messages are sent. Unused credits are not refundable unless we end the service without cause
• Meta may change its message charges. When it does, we will update our rates with notice

Availability

We work to keep the service running, but message delivery depends on Meta's platform, the recipient's phone and the internet. We do not guarantee that every message will be delivered, or delivered at a particular time. Urgent or safety-critical information should not depend on WhatsApp alone.

Suspension and termination

We may suspend the service if a Customer breaks these terms or WhatsApp's policies, or if Meta restricts the account. The Customer can stop using the service at any time. After the service ends, data is deleted as described in our Privacy Policy.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

4. Payment Terms

All fees for our services are payable in advance. Payment can be made through our authorized payment gateways. Prices are subject to change with prior notice.

Refunds are subject to our refund policy, which may vary depending on the course or service purchased.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Nipun India Skill Development And Training Private Limited and its licensors.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service.

6. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Use the Service for commercial purposes without authorization

8. Disclaimers

The information on our Service is provided on an "as is" basis. Nipun India Skill Development And Training Private Limited makes no warranties, expressed or implied, and hereby disclaims all warranties.

In no event shall Nipun India Skill Development And Training Private Limited be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever.

Upon termination, your right to use the Service will cease immediately.

These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
